Terms of Service

Agreement to these terms

By accessing or using Unfair Judge (the “Service”) you agree to these Terms of Service. If you do not agree, do not use the Service.

The Service

Unfair Judge is a fan-rating platform where users score NBA referees on a 1–5 star scale and post comments tied to specific games. Browsing is open to anyone. Rating and commenting require a signed-in account.

Eligibility

You must be at least 13 years old (or 16 in the EEA) to create an account. By signing in you represent that you meet this requirement.

Your account

We use Google OAuth for sign-in. You are responsible for activity that occurs under your account and for keeping your Google account secure. If you believe your account has been accessed without authorization, contact us immediately at support@thebandindex.com.

User content

You retain ownership of the ratings and comments you submit (“User Content”). By submitting User Content you grant Unfair Judge a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and aggregate that content as part of operating the Service. Aggregate and anonymized data derived from User Content may be retained after account deletion to preserve the integrity of referee scores, as described in our Privacy Policy.

Acceptable use

Keep it about the calls. You agree not to:

• Post hate speech, harassment, threats, or sexually explicit content
• Dox, threaten, or incite violence against officials, players, or other users
• Impersonate any person, official body, or entity
• Submit spam, advertising, or links to malicious content
• Use automated systems to rate, comment, or scrape the Service at scale
• Attempt to break, overload, or reverse-engineer the Service
• Violate any applicable law

Moderation

We screen comments for disallowed content using automated tools and may remove content and suspend or terminate accounts at our discretion, with or without notice, particularly for violations of the acceptable-use rules above.

Not affiliated with the NBA

Unfair Judge is an independent, fan-run project. It is not affiliated with, endorsed by, or sponsored by the National Basketball Association, its teams, officials, the NBRA, or any league entity. Team names, referee names, and game data are used nominatively for editorial commentary and identification.

Third-party data

Game schedules, box scores, and officiating assignments are sourced from third-party public data providers. We make no warranty as to the accuracy, completeness, or timeliness of that data.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Ratings and comments are the subjective opinions of fans and do not represent the position of Unfair Judge, the NBA, or any official.

Limitation of liability

To the maximum extent permitted by law, Unfair Judge and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim related to the Service is limited to one hundred U.S. dollars (USD $100) or the amount you have paid to use the Service (currently nothing), whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Unfair Judge and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms.

Termination

You may stop using the Service and delete your account at any time via your account deletion page. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive (including ownership, disclaimers, liability limits, and indemnification).

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California.
